TERMS AND CONDITIONS

1. General Booking and Session Policies

1.1 Our sessions bookings are flexible but are booked in minimum blocks of 6 sessions.

1.2 Your sessions can be rearranged for alternative days and times based on our availability but you must provide us with 24 hours of notice or we will not be able to rearrange your session and it cannot be used as a credit for a future lesson. 

1.3 Trident Swimming will provide all necessary and requested equipment and will ensure all equipment is suitable for use.

1.4 You should not swim if they have any significant illness such as ear infection, chickenpox or a very bad cold. If any person entering the water has had sickness or diarrhoea, they should not use swimming pools whilst symptomatic, or for 48 hours after symptoms have completely ceased. People diagnosed with cryptosporidiosis should not use swimming pools for 14 days after symptoms have resolved and should inform Trident Swimming immediately if diagnosed.

1.5 It is your legal responsibility to disclose any pertinent medical information regarding you (adult lessons), your child (children’s lessons), or you and your baby (parent & baby lessons). This must be provided in writing via email, so the details can be included in the child’s medical notes on the Trident Swimming database. 

1.6 You are fully responsible for ensuring you (adult sessions) your child (children’s sessions), or you and your baby (parent & baby sessions) are fit and healthy to attend the classes. If you or your child/baby have any existing medical conditions you should seek advice from your doctor prior to attending the sessions. In some cases, a doctor’s note may be required confirming you and/or your child are able to partake in the sessions. Whilst every care will be taken to ensure the health and safety of everyone booked into our sessions, Trident Swimming does not accept any responsibility for any negative impact on the sessions or you and/or your child’s wellbeing due to a medical condition that was or was not disclosed to us. Trident Swimming also reserves the right to cancel the session in this case (without a refund should the medical condition not have been disclosed)

1.7  Trident Swimming can only be responsible for children during their swimming session and the parent/guardian is responsible at all other times.  Children's swimming session begins when the Trident Swimming instructor accepts the charge of the child and ends when the child is returned to the parent or guardian

1.8  A parent or guardian must accompany the child in the water for parent and baby session only. Trident Swimming can only be responsible for children during the parent and baby lessons while holding the child during the session and the parent/guardian is responsible at all other times

1.9 Adult swimming sessions are provided with the understanding that the client is swimming and using the facilities at his or her own risk

1.10 Trident Swimming will ensure you have the same coach for all of your sessions, should the coach be unable to attend your lesson for sickness or travel issues you will be informed and your lesson will be reorganised. 

1.11 Trident Swimming's baby, toddler and children's sessions are recommended to run as 1 to 1, 1 to 2 or small group based on your requests with the instructor in the water with the child. In order for the instructors to properly execute these lessons, they will need to physically handle the child in a professional manner to provide support in the water, and to convey correct stroke techniques.

1.12 Trident Swimming adult sessions are mostly run with the instructor outside of the water.  However, in some cases with less confident adult learners, in order for the instructors to properly carry out these sessions, they may need to enter the water to physically handle the student in a professional manner to provide support in the water, and to convey correct stroke techniques.

1.13 The Trident Swimming team will advise you based on our expertise what the most beneficial program is for you, your child or children, however, ultimately the decision is the clients to decide on the final program. 

1.14 The initial consultation session is free but is not compulsory and should you choose, your sessions can instead be organised over email or phone. If you choose to have the consultation session and are an adult who can swim without assistance, the Trident Swimming coach can observe your swimming for 15 minutes in order to go away and effectively build a program. This is not compulsory and is not available for baby, toddler, child or novice adult sessions.  

1.15 Filming/photography is part of various packages that Trident Swimming offers.  If you would like video analysis or underwater photography you will need to sign a form which will be provided during the initial consultation session. 

1.16 Any changes you wish to make to your booking need to be emailed to contact@tridentswimming.co.uk.

2. Cancellation Policies

2.1 If within 7 days of the booking email being issued you inform Trident Swimming that you would like to cancel your block of sessions, you will receive a refund of the fees paid, less an administration charge of 10% of the full invoice fee (incl. of VAT)

2.2 If you need to cancel an upcoming lesson and provide Trident Swimming with a minimum of 24 hours notice we can rearrange your session or apply a credit to your account to be used within 6 months of the cancellation date. If you inform Trident Swimming less than 24 hours before your session that you cannot attend you will be charged in full and the session cannot be rearranged or credited. 

2.3 If you are unable to attend your block of sessions due to sickness we can provide you with a credit for future sessions. If the sickness is long term and rearranging sessions is not possible, Trident Swimming can provide you with a full refund once an official note from your qualified GP, consultant or specialist has been received.

4. General Financial Policies

4.1 All requests for cancellations or refunds need to be made in writing and sent via email to Trident Swimming.

4.2 Refunds are provided via bank transfer or card should you have made a card payment.  Please contact Trident Swimming to arrange the refund to your card.  If you made payment via bank transfer, will also need to contact Trident Swimming with your banking details: Bank Name, Account Holder Name, Sort Code and Account Number.  For security purposes, please do not provide any banking or card details via email.

4.3 If you are a pool owner and are not available to attend a lesson but do not inform Trident Swimming you will be fully charged. This also applies to friends or family of pool owners attending sessions with Trident Swimming. All clients will be provided with alternative sessions as long as they provide 24 hours notice of their inability to attend.

4.4 If Trident Swimming has to cancel a session for any reason other than a Force Majeure Event (as detailed in 4.5), an alternate lesson will be provided, or a refund for that lesson will be paid if an alternate session cannot be provided.

4.5 If Trident Swimming has to cancel a session or a block of sessions due to a Force Majeure Event (such as, but not limited to, pandemics/epidemics or actions of government), credit for any cancellations that occur will be applied to your Trident Swimming account.  These credits will be available for use for any sessions in the future for up to two years after the cancellation occurs.

4.6 If Trident Swimming does not receive the necessary banking or card details as detailed in clause 4.2 within 12 weeks of any credit being applied to your account, the refund will become null and void (apart from the credit applied under clause 4.5)

4.7 If full payment for any booking is not made within 7 days of the booking email being sent, or the date stated in the email, then Trident Swimming is unable to guarantee your place and it will be opened to other bookings.

5. Privacy, Agreement & Changes To Terms

5.1 Trident Swimming will not use, or make available any personal information that we hold to any third party not directly responsible for, or connected with the servicing of your booking. Trident Swimming will not use your personal information except to send you related service and marketing communications. If you wish to be removed from our mailing list please inform us by replying to one of the emails you have received with UNSUBSCRIBE, and your details will be unsubscribed from our mailing list. 5.2 We may from time to time change these Terms and Conditions without giving you notice, but we will use our reasonable endeavours to inform you as soon as is reasonably possible of any such change.

5.3 Your payment indicates that you have read and agree to these terms and conditions, which includes how your data will be processed (detailed on our privacy policy page).

5.4 Should you make and pay for a booking over the phone or online, it is your responsibility to have fully read and understood these terms and conditions before proceeding with the booking.
